Trips outside the US

Physical presence — the numbers

5-year rule: 30 months / 913 days of physical presence.
3-year rule: 18 months / 548 days (US-citizen-spouse route).
Continuous residence: Trips >6 months but <1 year create a rebuttable presumption of break.
Trips ≥1 year: Generally break continuous residence — re-set the clock, unless you filed an N-470.

Rebuttable presumption (6–12 months)

If a single trip is between 6 and 12 months, USCIS presumes you broke continuous residence — but you can rebut the presumption with evidence that you:

Did not terminate US employment
Retained a US residence (lease, mortgage)
Kept family in the US
Maintained US bank accounts and tax residency

Early filing window

You may file the N-400 up to 90 days before you meet the 5-year (or 3-year) requirement. The 90-day window applies only to continuous residence — physical presence and all other requirements must still be met at filing.
